Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners seek regular bail in connection with Maharajganj P.S. Case No. 62 of 2021 lodged under Sections 302, 201, 328, 120B, 34 of the I.P.C.

As per the prosecution case, the allegation against the present petitioners are that she called the deceased and in connivance with other co-accused persons have provided poison due to which the deceased died and thereafter, concealed the

Learned counsel for the petitioners submit that petitioners are innocent and have committed no offence. He submits that the F.I.R. has been filed only and only on the basis of suspicion. There is no cogent material found against the present petitioners in this case. Their name have figured only due to the reason that the deceased was used to meet with the petitioners. Learned counsel submits that deceased died due to heavy drinking and he was in habit of felling down many places in drunken state. But due to enmity and village politics, the name of petitioners have been implicated in the present case. Learned counsel further submits that petitioners are in custody since 04.03.2021 and charge sheet has already been filed in this case and antecedent of the petitioners are clean. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioners above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Siwan in connection with Maharajganj P.S. Case No. 62 of 2021, subject

Patna High Court CR. MISC. No.72593 of 2021(4) dt.29-11-2022 3/3 to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
