Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 26-07-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 465, 468 and 120(B)/34 of the Indian Penal Code.

The crux of the case is that the petitioner got tested Covid-19 on 19.05.2021 wherein he was found negative but the report was placed before the learned ACJM, Manjhaul as positive by committing fabrication in the Covid-19 test of the petitioner and thereafter this case has been registered on the direction of the learned ACJM, Manjhaul.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner is not named in the FIR rather his name transpired in the confessional statement of co-accused Lal Mohan Kumar. He further submits that the petitioner has

He further submits that co-accused Lal Mohan Kumar has enemical relation with the petitioner as there was Rs.50,000/- was due with Lal Mohan Kumar and the petitioner was pressurizing to return the same. He further submits that similarly situated co-accused has already been granted anticipatory bail by this Court passed in Cr. Misc. No. 65240 of 2021.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Manjhaul, Begusarai in connection with Cheriya Bariyarpur P.S. Case No. 117 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
