08-12-2015 Heard Mr. Ram Prasad Singh, learned counsel for the petitioner and Sri Damodar Prasad Tiwary, learned Addl. Public Prosecutor.
The petitioner, who is in custody in Ben P.S. Case No. 154 of 2013 registered for the offence under Sections 406, 420, 467, 468/34 of the Indian Penal Code, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that initially, a complaint case was filed by the informant, vide Complaint Case No. 1035C of 2013, which was referred to police under Section 156(3) of the Cr.P.C. and thereafter, F.I.R. was lodged. He submits that the informant himself had obtained loan from the Madhya Bihar Gramin Bank and since he defaulted to pay the loan amount, a certificate proceeding was initiated against
Patna High Court Cr.Misc. No.52567 of 2015 (2) dt.08-12-2015 2/2 the informant and his wife and only thereafter, the present complaint petition was filed. He further submits that the Branch Manager of the Bank, against whom there was serious accusation than the petitioner, has already been granted anticipatory bail by the court below itself.
Keeping in view the fact that one of the co-accused has been granted anticipatory bail and the petitioner is in custody, let the petitioner namely Munna Ram @ Avishek Kumar @ Avshekh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st Class, Nalanda at Biharsharif/concerned court in connection with Ben P.S. Case No. 154 of 2013.
