The State of Bihar

The impugned order, in toto, reads as under:- "The short prayer of the petitioner in the present writ petition is to make payment of the outstanding due amount totalling to a sum of Rs. 48,692/- for the work done by the petitioner. The learned counsel for the respondents has filed a counter affidavit wherein it has been stated that the Panchayat Sewak i.e. the Executing Agency has given a written statement that he has received a sum of Rs. 1,05,000/- and he has got no further claim as far as the connected scheme is concerned. Thus, the submission of the learned counsel for the respondents is that as far as the State Government is concerned, the admissible amount has already been paid.

In view of the statement made by the learned counsel for the respondents in their counter affidavit, nothing survives in the present writ petition, hence the present writ petition is disposed of."

We find no infirmity/illegality/perversity with the impugned order.

As such, the present Letters Patent Appeal stands disposed off, reserving liberty to the appellant to pursue the remedies, other than the subject matter of the present appeal, if so required and desired, in accordance with law.
