JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 06-04-2016 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner apprehends his arrest in a case instituted under Sections 420, 409, 406 and 34 of Indian Penal Code. As per prosecution case, a sum of Rs.1 crores 90 lakh and odd was distributed amongst 77 persons for implementation of government schemes. A sum of Rs.68,000/- was allocated to the petitioner.

Learned counsel for the petitioner submits that he has completed the work and in fact, he is entitled to receive a further sum of Rs.24,000/- from the Department.

Having regard to the facts and circumstances of the case, in the event of arrest/surrender, let the petitioner named above, be released on bail on furnishing bail bond of Rs.5,000/- with two

Patna High Court Cr.Misc. No.41395 of 2014 (5) dt.06-04-2016 2/2 sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Mahishi P.S. Case No. 150 of 2010, with the condition that he would not physically absent for two consecutive dates at a stretch, till one witnesses is examined in the case.
