2. The petitioner has preferred this application for grant of regular bail in connection with Shahpur P.S. Case No. 281/2023, registered under sections 302, 147, 148, 149 and 341 of the Indian Penal Code and section 27 of the Arms Act.

3. As per prosecution case, seven named accused persons including the petitioner herein came to the shop where the brother of the informant was taking breakfast and demanded rangdari from the informant's brother. They started abusing him on which the persons gathered told him to leave the said place. It is further stated that subsequently once again all the accused persons came at their house and hurling abusing called Raju Rai. Meanwhile the informant's brother came out of his house. Bitan Sharma and other persons gave orders to shoot him.

Patna High Court CR. MISC. No.64239 of 2023(2) dt.11-10-2023 2/2 Bishokkha Rai shot him and he fell down on the ground.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. The allegation against the petitioner are general and omnibus in nature. The subsequent allegation of overt tact is on Bishokkha Rai. The petitioner is in custody since 21.04.2023 and charge-sheet has been submitted in this case. He has no criminal antecedent.

5. The prayer of the bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the general and omnibus allegation in the F.I.R., the accused Bishokkha Rai having been described as assailant of the deceased and the petitioner not having any criminal antecedent, is directed to be enlarged on bail in connection with Shahpur P.S. Case No. 281/2023, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Danapur (Patna).
