JUSTICE SANJAY PRIYA ORAL ORDER 18-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Bettiah Town P.S. Case No. 174 of 2014 instituted for the offence under Sections 399, 402 and 120(B) of the Indian Penal Code. It is alleged that the police after receiving secret information that some miscreants are making plan for committing offence, they rushed to the place of occurrence. On seeing the policy party, the miscreants started to flee away but two of them were caught by the police who disclosed their names as Golu Kumar and Antim Kumar.
It has been submitted on behalf of the petitioner that two accused persons namely, Golu Kumar and Antim Kumar were apprehended by the police who took the name of the petitioner and
Patna High Court Cr.Misc. No.10788 of 2017 (2) dt.18-03-2017 2/2 other accused persons as mentioned in the written report. In such circumstances, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Bettiah Town P.S. Case No. 174 of 2014, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
