The petitioner seeks regular bail in Belaganj P.S. Case No. 323/2018, registered for the offences punishable under Sections 30(G), 34 and 36 of the Bihar Prohibition & Excise Act and sections 2(e), 3, 5(b), 18 and 42 of Mahua Flower Niyamavali.

It is alleged in the written report that 1000 KG of Mahua Flower has been recovered from a pick-up van. Petitioner was driver of the said pick-up van. Learned counsel for the petitioner has submitted that petitioner is in custody since 03.11.2018 having clean antecedent.

Considering the facts and circumstances of the case,

Patna High Court Cr.Misc. No.699 of 2019(2) dt.18-01-2019 2/2 prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Gaya in connection with Belganj P.S. Case No. 323/2018, subject to the condition that both the bailors will be close relative of the petitioner.
