2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 115(2), 126(2), 69, 351(2), 352 and 3(5) of the B.N.S and under Section 3, 4 of Dowry Prohibition Act.
3. The prosecution story, in short, is that the marriage of the informant was fixed with the petitioner for 25.04.2025. The engagement ceremony was held on 08.03.2024 and the 'Cheka' ceremony on 13.07.2024. A dowry of Rs. 10,00,000/- was demanded, out of which Rs.

It is alleged that on 09.06.2024, the petitioner forcibly established physical relations with the informant on the pretext of marriage, and such relations continued till 16.11.2024. It is further alleged that subsequently, on 25.11.2024, the petitioner demanded a four-wheeler in addition to the agreed dowry, and upon denial, the family of the petitioner refused to solemnize the marriage of the petitioner and the informant.
4. Learned counsel for the petitioner submits that the informant is a major and her marriage was fixed with the petitioner for 25.04.2025. It is urged that after the engagement on 08.03.2024, the 'Cheka' ceremony was held on 13.07.2024. Thereafter the petitioner and the informant continued to have physical relations on several occasions. The acts of repeated intimacy and sexual relations were totally consensual in nature and were not established under any false promise, when the relationship went sour leading to strife and culminated into the F.I.R. He further points out that Rs. 1,70,000/- which was given by informant has already been returned. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the backdrop of the case, clean antecedent, the fact that their was consensual relationship between the parties, informant being a major and well aware of the outcome of the relationship, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Siwan in connection with Mahila P.S. Case No. 4 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
