JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 30-06-2021 Heard learned counsel for the petitioner and learned counsel for the State via video conferencing. This application has been filed for restoration of Cr.WJC No.460 of 2017 which was dismissed for want of prosecution on 31st July, 2019.

Learned counsel appearing for the petitioner submits that on 31st July, 2019, while Cr.WJC No.460 of 2017 was called out, he was arguing another matter before another Court. By the time, he finished his argument before another Court and came to this Court, the criminal writ petition vide

Patna High Court MJC No.3502 of 2019(2) dt.30-06-2021 2/2 Cr.WJC No.460 of 2017 was dismissed for want of prosecution. He submits that there is neither deliberate nor willful laches on the part of the petitioner or his counsel.

Learned counsel for the State does not oppose the prayer for restoration of Cr.WJC No.460 of 2017. Having considered the submissions advanced at the Bar and the pleadings made in the application, the restoration application is allowed.

Cr.WJC No.460 of 2017 is directed to be restored to its original file.
