2. The petitioner has preferred this application for grant of regular bail in connection with NDPS Case No. 81/2021 arising out of Industrial Area P.S. Case No. 159 of 2021 dated 02.12.2021 registered for the offences punishable u/ss 20(b)(ii)(c) and 22 of the N.D.P.S. Act.
3. As per the prosecution case, total 23.5 kgs. Of ganja was recovered from the house of the petitioner who was apprehended on the spot.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in
Patna High Court CR. MISC. No.60196 of 2025(2) dt.15-11-2025 2/3 this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged recovery. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 03.12.2021.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the seized contraband is commercial quantity. Earlier the regular bail of the petitioner was rejected by the co-ordinate bench of this court vide order dated 29.11.2023 passed in Cr. Misc. No. 51660/2022. The petitioner has no valid authorization for keeping the said contraband.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bhagalpur in connection with NDPS Case No. 81/2021 arising out of Industrial Area P.S. Case No. 159 of 2021, with the condition:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date,
Patna High Court CR. MISC. No.60196 of 2025(2) dt.15-11-2025 3/3 failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner is liable to be cancelled.
