JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2019 Earlier prayer for bail of the petitioner was rejected by this Court twice vide order dated 4.8.2017 in Cr.Misc.No. 33598 of 2017 and vide order dated 21.3.2018 passed in Cr.Misc.No. 20172 of 2018 considering the allegation of firing on the deceased and causing his death against the petitioner and other co-accused.
Submission of learned counsel for the petitioner is that petitioner is in custody for about two years and there is no substantial progress in trial.
Heard learned APP also.
Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioner. However, considering the fact that petitioner is in custody for two years, learned trial court is directed to expedite
Patna High Court Cr.Misc. No.1100 of 2019(2) dt.23-01-2019 2/2 the trial by conducting it on regular basis and try to conclude it as early as possible.
With the above observation, this application is dismissed.
