JUSTICE ARUN KUMAR ORAL ORDER 28-06-2017 This quashing petition is assailed against the order dated 3.2.2014 passed by learned C.J.M., Araria in Forbesganj (Simraha) P.S. Case No.113 of 2013 whereby he has taken cognizance of the offence under Sections 341, 323, 324, 307, 302 and 504/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the allegation of assault on the deceased is not against the petitioners. The only allegation against them is that they assaulted with lathi and danda to others. The postmortem report does not show any injury caused by these petitioners.
This petition is dismissed with liberty to the
Patna High Court Cr.Misc. No.18945 of 2014 (4) dt.28-06-2017 2/2 petitioners to raise these points before the court below at the time of framing of the charge.
