JUSTICE SANJAY PRIYA ORAL ORDER 14-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 302 and 328/34 of the Indian Penal Code.
It has been submitted that there is specific allegation against co-accused Mantu Kumar of calling son of the informant to take liquor and administering poison to him. There is general and omnibus allegation against the petitioner in the written report. It has further been submitted that co-accused Mantu Kumar with similar allegation has already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 22.10.2016 passed in Cr. Misc. 44343 of 2016.
Considering the facts and circumstances of the case,
Patna High Court Cr.Misc. No.4948 of 2017 (2) dt.14-02-2017 2/2 let the petitioners above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Bihar P.S. Case No. 428 of 2015, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif, subject to the conditions as laid down under Section 438 (2) Cr.
