JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and three others are said to have demanded extortion money from informant and also made indiscriminate firing. Petitioner is said to have been caught on the spot by the informant and police officials.
Contention on behalf of the petitioner is that the informant is a veteran criminal and as a matter of fact, no such occurrence did ever take place. To fortify the aforesaid contention, he drew my attention towards Annexure-3 to this petition, which is an order for issuance of notice to the informant for his detention under Control of Crimes Act, passed by District Magistrate, Saharsa.

No.88 of 2016 (2) dt.06-01-2016 2/2 Considering the above-said facts and circumstances of the case as well as submission of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sour Bazar P.S. Case No. 351 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Saharsa.
