ANJANA MISHRA ORAL ORDER 09-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 06.01.2019, in connection with Khagaria (Mufassil) P.S. Case No. 910 of 2018 for the offences under Sections 379 and 411 of the Indian Penal Code.

Learned counsel for the petitioner submits that the alleged recovery was from one Chandan Yadav who confessed his guilt and indicated that the petitioner was also involved in the occurrence. It is under such confession made before the police by the said Chandan Yadav that the petitioner was taken into custody in connection with the present case. Learned counsel for the petitioner further submits that no TI parade has been conducted till now and the petitioner is languishing in jail.

No.73828 of 2019(3) dt.09-12-2019 2/2 Considering the aforementioned facts and circumstances and also because the said Chandan Yadav has since been extended the privilege of bail in Cr.Misc. No. 32788 of 2019 vide order dated 17.05.2019, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria (Muffasil) P.S. Case No. 910 of 2018.
