1. Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 303(2), 352, 351(2), 3(5) of the B.N.S.

3. The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that while he was returning to his house on bike when he was intercepted by the accused persons and Saurav assaulted by Hasua causing injury on head, thereafter Prashant assaulted by Dabiya on head causing injury.

4. The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that though there is specific allegation against the petitioner of assaulting the informant, but then, from perusal of the suppementary injury report annexed as Annexure-2 to the anticipatory bail application, it would manifest that the injury suffered by the injured has been opined to be simple. It is further submitted that an altercation had taken place in between the informant's side and the side of the petitioners when the occurrence is alleged to have taken place. It is also submitted that even from the side of the petitioners also some persons were injured. It is next submitted that since injury is simple in nature that amply demonstrates that petitioners never had any intention of committing a serious occurrence. It is reiterated and submitted that petitioners are persons with clean antecedent and are not criminals.

5. Learned A.P.P. opposes the anticipatory bail application.

6. Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on

No.60169 of 2025(2) dt.16-09-2025 3/3 anticipatory bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Pramoda Kumar, the learned S.J.-cum-ACJM-IV, Vaishali at Hajipur in connection with Mahua P. S. Case No.633 of 2025, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The application stands allowed.
