1. Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504, 506 and 34 of the Indian Penal Code.

3. The learned counsel for the petitioners submits that the petitioner no.1 has antecedent of one case and petitioner no.2 is a person with clean antecedent and the informant alleges that accused persons came variously armed and started abusing, on protest, all accused assaulted him and thereafter, Anuranjan and Sandeep caught him while Ram Haresh Sahani assaulted

4. The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is also submitted that from perusal of the allegation as alleged in the FIR, it would manifest that specific allegation of assaulting the informant is against Ram Haresh Sahani, the petitioners are not alleged to have assaulted. It is next submitted that petitioners have been implicated in the instant case with an allegation that they caught the informant while Ram Haresh Sahani assaulted him. It is further submitted that in order to implicate the petitioners, the said allegation was alleged.

5. Learned A.P.P. opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Court No.2 of learned J.M., 1st Class, Muzaffarpur West in connection with Paroo P. S.

Patna High Court CR. MISC. No.64293 of 2024(2) dt.17-10-2024 3/3 Case No.09 of 2024, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The application stands allowed.
