Heard the learned counsel for the petitioner and learned APP for the State.

This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 30(a) of Bihar Prohibition and Excise (Amendment) Act, 2018, registered in connection with Buxar (T) P.S. Case No. 183 of 2021. The learned counsel for the petitioner has submitted that 76 litre of illicit liquor was recovered from the possession of the coaccused persons, namely, Balbahadur Yadav and Dinanath Turha, who disclosed the name of one Kallu Yadav and the present petitioner. He has submitted further that thepetitioner was not

Learned counsel for the petitioner has submitted further that co-accused, namely, Bal Bahadur Ram, who was apprehended at the spot, has already been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 41875 of 2021, vide order dated 22.01.2022 and the petitioner is in custody since 04.10.2021. Considering the above facts and circumstances as well as period of custody i.e. 04.10.2021, let the petitioner above-named be released on bail after framing of charge on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge, Excise Act, Buxar, in connection with Buxar (T) P.S. Case No. 183 of 2021.
