The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504 of the Indian Penal Code and Section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
It is alleged that the petitioner demanded toddy free of cost from the informant and on refusal of the same informant assaulted on his head by 'lathi' when his wife came to rescue she was assaulted and petitioner also snatched ear-ring of the wife of the informant.
It is submitted by learned counsel for the petitioner that the injury has been found simple in nature and the petitioner also
Patna High Court Cr.Misc. No.10882 of 2015 (2) dt.24-04-2015 2/2 lodged Nardiganj P.S. Case No.138 of 2014 against the informant. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Nardiganj P.S. Case No.121 of 2014, pending before the learned Chief Judicial Magistrate, Nawadah.
With the above observation, this application is, accordingly, disposed off.
