The petitioner seeks bail in Jaipur P.S. Case No. 32 of 2018 instituted for the offences under Sections 147, 148, 149, 448, 341, 323, 324, 325, 307, 354(B), 504 and 506 of the Indian Penal Code.

The main allegations are against Shaligram Das and Baijnath Das who are stated to have assaulted with weapons. The other co-accused Khiro Das and others have been granted bail by co-ordinate Benches of this Court on 18.12.2018 and 19.12.2018 in Cr. Misc. Nos. 75976 of 2018 and 74621 of 2018 respectively.

Keeping in view the status of the applicant being similar to the other said two accused and being distinguishable

Patna High Court Cr.Misc. No.1738 of 2019(2) dt.18-01-2019 2/2 from the facts of Shaligram Das and Baijnath Das, the applicant is entitled for bail.

Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1, Banka in connection with Jaipur P.S. Case No. 32/2018, subject to the following conditions:

One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he/she is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner and the petitioner will be well represented on each date and if he/she fails to do so on two consecutive dates, his/her bail will be liable to be cancelled.
