JUSTICE SUDHIR SINGH ORAL ORDER 20-07-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 143, 341, 342, 323, 382, 504 and 506 of the Indian Penal Code.
The informant has alleged that on 8.10.2013 at 7.00 hrs he was returning from Saharsa to his house and when he reached near the house of Anirudh Yadav then the FIR named accused persons and some unknown miscreants obstructed him and accused Bikky Ram put pistol in his temple and by abusing took out Rs. 8070/- and golden chain worth of Rs. 29,000/-, Nokia Mobile and documents of vehicle and they also committed occurrence of assault with the informant.
Patna High Court Cr.Misc. No.22180 of 2015 (3) dt.20-07-2015 2/2 It has been submitted on behalf of the petitioners that it is a case and counter case. The informant of present case is an accused in the counter case, which is Annexure 2 to the present application. It is also submitted that the petitioners have got no criminal antecedent.
On behalf of the State, it has been submitted that the petitioners are named in the FIR.
Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M.,Saharsa, in connection with Bihra P.S.Case No. 194 of 2013 arising out of G.R.No. 2220 of 2013, subject to the conditions as laid down u/s 438(2) Cr.P.C.
