JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date : 12-09-2018 The instant writ petition has been filed by the petitioner for a direction to the respondents to pay difference of UGC salary from January, 2006 to May, 2013.

On behalf of the respondents stand has been taken in para-8 of the counter affidavit that the State Government has released its share to the University for payment of salary to the teaching staff under the UGC Scheme vide memo no. 848 dated 24.4.2013. It has further been indicated in para-15 that the

Patna High Court CWJC No.24042 of 2013 dt.12-09-2018 2/2 Government has released Rs. 8,06,22,19,212/- towards payment of salary from 1.1.2006 to 31.3.2010 and the petitioner has been paid. Learned counsel for the University submits that so far as the payment of arrears on account of UGC pay revision, the State Government has not released appropriate fund and as such the University is unable to make payment. He further submits that none in the University has been paid beyond 31.3.2010. As soon as the fund is made available to the University towards payment of UGC scale beyond 31.3.2010, the case of the petitioner shall be considered and paid arrears along with other similarly circumstanced.

The Court hopes and trusts that appropriate fund towards payment of arrears of UGC if released to the University, the University will ensure payment of the same.
