The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 8(c)/21 (b) of the Narcotic Drugs and Psychotropic Substance Act, 1985. As per prosecution, the allegation against the petitioner is that 14 pouches like smack weighting 6.3 gram was recovered from his possession. Accordingly, seizure list has been prepared. The alleged seized smack and narcotic substance more than small in quantity and less than commercial quantity. Learned counsel for the petitioner submitted that the petitioner is falsely implicated in this case and he is quite innocent and is in custody since 07.06.2022.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Special (NDPS) Case No. 105 of 2022, arising out of Phulwari Sharif P.S. Case No. 637 of 2022 on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge- XXIV, Patna.
