In view of the fact that the writ petition has been dismissed by order, dated 24.08.2015, on the ground that so long as the order, dated 03.04.2012, passed in C.W.J.C. No.4488 of 2012, remains in force, no order can be passed by the Court in C.W.J.C. No. 11476 of 2011 granting relief sought for by the

Patna High Court LPA No.437 of 2016 (3) dt.12-07-2016 2/2 petitioner and, therefore, the Stated-respondents shall do the needful as and when the vacancy in the post of Lady Supervisor arises.

It is, now, submitted by Mr. Abdul Mannan Khan, learned Counsel, appearing on behalf of the appellant, that the appellant seeks to withdraw the present appeal with liberty to challenge the order, dated 03.04.2012, passed in C.W.J.C. No. 4488 of 2012, so that the legal impediment created by the order, dated 03.04.2012, can be overcome.
