The petitioner apprehends her arrest in Bhagwanpur Hat P. S. Case No. 52 of 2016 registered for the offences under Sections 323, 363, 366, 354, 376, 511 and 34 of the Indian Penal Code.

The informant filed a complaint case and on the basis of which the present F.I.R. was lodged. The informant alleged that Pintu Kumar with the help of the petitioner took her daughter to Siwan Railway Station from her house and Kahinath, Urmila Devi and Babita Kuamri were available at Siwan railway station. It is alleged that the accused persons forcibly made her sit in the train and Pintu Kumar took her to Delhi. The informant further alleged that Pintu Kumar kept her in the house

Learned counsel for the petitioner submits that from the complaint petition and also from the statement of the girl recorded under Section 164 of the Code of Criminal Procedure, it appears that the victim travelled along with Pintu Kumar at her own. Victim is a major girl. Other accused persons, namely, Urmila Devi and Babita Devi have already been granted bail. Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in Bhagwanpur Hat P. S. Case No. 52 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
