The Petitioners apprehend their arrest in Bihar P.S. Case No.468 of 2016 instituted for the offence under Section(s) 323, 341, 324, 504, 506, 325, 379, 307/34 Indian Penal Code and Section 27 of the Arms Act pending in the Court of the Chief Judicial Magistrate, Nalanda at Biharsharif.
There is specific allegation in the written report against the petitioners and other accused persons of assaulting the informant and his father with Khanti, iron rod, butt of the pistol etc.
Case diary has been received.
The doctor has found injuries on the person of the
Patna High Court Cr.Misc. No.8957 of 2017 (4) dt.18-04-2017 2/2 informant and his father. Although injuries are simple in nature, but the Injury Reports fully support the allegation against the petitioners.
From paragraph 3 of the bail petition, it appears that both the petitioners have criminal antecedents. In view of such, this Court does not find it a fit case for grant of anticipatory bail.
Prayer is rejected.
The petitioners may surrender before the Court below and seek regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order.
