JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2019 This is an application for grant of anticipatory bail in connection with Sirdala P.S. Case No. 52 of 2018, disclosing offences under Sections 341, 323, 307, 379, 427, 498, 504, 34 of the Indian Penal Code and Section 3/4 of Prevention of Witch Craft Practice Act.
Allegation against the petitioners is that by calling the informant as Dayan, they have assaulted her and the specific allegation against petitioner nos. 1 & 2 is of assault by iron rod and also allegation of assault against petitioner no.3. Submission of learned counsel for the petitioners is that there is general and omnibus allegation against the petitioners. Further, they have no criminal antecedents. Heard learned A.P.P. also, who opposed the prayer for
Patna High Court Cr.Misc. No.78660 of 2018(2) dt.10-01-2019 2/2 anticipatory bail of the petitioners stating that by calling the informant as Dayan, they have assaulted her and impugned order shows that injures are grievous in nature. Having heard both sides, considering the above facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioners, rather they should surrender before the court below and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court.
Accordingly, this application is dismissed.
