JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Basopatti P.S. Case No. 184 of 2018, registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30 (a) of Bihar Prohibition and Excise Act, 2016.

As per F.I.R. there is recovery of more than 100 liters liquor from the motorcycle. Petitioner is not named in the F.I.R and during investigation it transpires that motorcycle belongs to one Ram Nath Kumar Paswan and further case diary disclosed that the same is sold to the petitioner which is mentioned in the case diary.

Submission of the learned counsel for the petitioner is that petitioner is not named in the F.I.R and he has no concern

Patna High Court CR. MISC. No.60498 of 2019(5) dt.19-11-2019 2/2 with the seized liquor.

Learned A.P.P has opposed the bail prayer of the petitioner.

Having heard both sides, in view of the allegation as discussed above, I am not inclined to grant privilege of anticipatory bail to the petitioner.
