JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-08-2022 Though the present writ petition was filed for directing the Respondent-Bank authorities to pay the death cum retiral benefits of the deceased husband of the petitioner, who was compulsorily retired from service by an order dated 25.9.2012 and had died on 26.8.2015 and subsequently, the order of compulsory retirement had also stood quashed by the High Court, however, despite lapse of several years, the death cum retiral benefits
Patna High Court CWJC No.21237 of 2021(5) dt.24-08-2022 2/3 were not granted by the Respondent-Bank and the widow petitioner was left in lurch and harassed beyond limits, nonetheless, on account of the endeavours made by this Court and in view of the orders dated 18.7.2022 and 16.8.2022 passed by this Court, the Respondent-Bank has now paid the full amount of GPF, amounting to a sum of Rs. 13,94,542/-, a sum of Rs. 5,19,577/- on the head of gratuity, a sum of Rs. 17,32,863.63/- on the head of arrears of family pension, apart from some other sums, however, certain outstanding liabilities of the late husband of the petitioner has been deducted, as has been stated in paragraph no. 14 of the counter affidavit filed today in the Court.
The learned counsel for the petitioner submits that apparently, it appears that most of the death cum retiral benefits of the petitioner has stood paid, however, seeks grant of interest on the delayed payment of the aforesaid amount, which has been paid, after a lapse of about seven years.
Patna High Court CWJC No.21237 of 2021(5) dt.24-08-2022 3/3 any. Liberty, so sought, is granted.
It is needless to state that the petitioner would be free to avail such other alternative remedies as are otherwise available under the law with regard to her claim for grant of interest on account of delayed payment of the death cum retiral benefits to her.
Having regard to the facts and circumstances of the case, nothing survives for adjudication in the present writ petition, hence, the same stands disposed of.
