The present petition has been filed for grant of regular bail on behalf of the petitioner in connection with Bairiya P.S. Case No. 222 of 2019 registered for the offence punishable under Sections 366A/34 of the Indian Penal Code. The allegation is regarding kidnapping of the minor daughter of the informant by the petitioner herein. The learned counsel for the petitioner has submitted that a bare perusal of the statement made by the victim girl under Section 164 Cr.P.C. before the learned Magistrate would show that the victim girl had in fact gone to the maternal uncle's house on account of altercation with her mother, however, subsequently, she had returned back and in fact the victim girl
Patna High Court CR. MISC. No.58810 of 2019(2) dt.01-10-2019 2/2 has not mentioned about any sort of incident of kidnapping having taken place with her. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 06.07.2019.
Having regard to the facts and circumstances of the present case, this Court deems it fit and proper to grant regular bail to the petitioner, above named, on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand), with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Bettiah, West Champaran in connection with Bairiya P.S. Case No. 222 of 2019.
