The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 324, 379, 504/34 of the Indian Penal Code.

As per the prosecution case, on 25.08.2021 at about 11 o'clock, while the informant was cutting grass, the FIR named accused including petitioner, armed with lathi, danda farsa etc., came there and started assaulting him and when family members of informant came to rescue, they were also assaulted. Petitioner is alleged to have assaulted with Farsa to sister of informant, as a result of which, her index finger of right hand disconnected and she also sustained injury in thumb of left hand.

It is submitted on behalf of petitioner that there is

Patna High Court CR. MISC. No.19 of 2022(2) dt.21-07-2022 2/2 admitted land dispute between the parties and due to that, simple Maarpit took place and injury, caused by the petitioner to informant's sister, is not on the vital part of the body. Petitioner has got clean antecedent.

However, learned A.P.P. for the State opposed the bail petition and submitted that there is specific allegation against this petitioner of causing grievous injury to informant's sister. Considering the aforesaid facts and circumstances, I am not inclined to extend the privilege of anticipatory bail to the petitioner and same is, accordingly, rejected.
