JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-05-2022 Heard Mr. Hare Krishna Prasad, learned Advocate for the petitioner and learned Additional Public Prosecutor representing the State. The petitioner seeks bail in connection with S. Kamal P.S. Case No. 188 of 2021 dated 04.08.2021 instituted for the offences under Sections 120(b), 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Though several litres of liquor have been recovered on simultaneous raid from different places but, so far as the petitioner is concerned, there has been no recovery from his constructive possession. He is sought to be prosecuted in this case on the confession of one of the accused persons from whose house recovery of liquor has been made.

No.72514 of 2021(2) dt.26-05-2022 2/2 The petitioner is in custody since 01.11.2021 and in the two cases in which he was made accused earlier, in one of them he on police bail and in another, he has been granted bail. Considering the nature of accusation and the period of custody, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II cum Special Judge, Excise Act, Begusarai in connection with S. Kamal P.S. Case No. 188 of 2021.
