The petitioners apprehend their arrest in Govindpur P.S. Case No. 96 of 2011 instituted for the offence under Section (s) 341, 323, 324, 307, 302, 34 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that police after investigation submitted final form against the petitioners but no cognizance was taken against them. The petitioners have been summoned as accused under Section 319 Cr.P.C. during pendency of the trial of other accused persons. From the written report, it appears that there is no allegation of any specific overt act against these petitioners.

In the facts and circumstances of the case, the prayer of the petitioners for anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, above named, within six weeks from today in connection with Sessions Trial No. 189/12/323/14, arising out of Govindpur P.S. Case No. 96 of 2011, they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Nawada, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
