JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 304B/34 of the Indian Penal Code.
Heard learned counsel for the petitioners.
It has been submitted on behalf of the petitioners that they are brother-in-law and sister-in-law of the deceased. There is general and omnibus allegation against the accused persons including petitioners. It is further submitted that petitioners are residents of Kolkata and in this regard Adhar Card and Pan Card have been annexed, which are Annexure-2 series to this petition and petitioners are not concerned with the affairs of the deceased. Heard learned A.P.P. also.

No.8511 of 2017 (2) dt.28-02-2017 2/2 Having heard both sides, in view of the fact that they are brother-in-law and sister-in-law, no specific allegation is against them and they are residents of Kolkata, let above named petitioners, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, West Muzaffarpur, in connection with Saraiya P.S. Case no. 298 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and also subject to the conditions that (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioners shall cooperate in the investigation and make themselves available before the police as and when required.
