The petitioner seeks bail in connection with Marhowrah P.S. Case No. 482 of 2018 registered under Sections 302/34/120(b) of the Indian Penal Code.

Deceased Tarkeshwar Singh, is said to have broken the hand of the petitioner over the land dispute preceding to occurrence and in retaliation, the F.I.R. named accused persons, barring the petitioner, assaulted him by means of lathi, danda etc. resulting into his death. Petitioner is said to be the master mind of the said occurrence.

It is submitted by the learned counsel for the petitioner that petitioner is quite innocent and has been falsely

Patna High Court Cr.Misc. No.78345 of 2018(2) dt.11-01-2019 2/2 implicated in this case. She happens to be lady. She was not present at the place of occurrence at the time of occurrence. As a matter of fact, deceased himself assaulted the petitioner and broke her hand over the land dispute. Petitioner has been languishing in custody since 13.10.2018.

On the other hand learned APP opposed the bail prayer of the petitioners.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Chief judicial Magistrate-VIII, Saran in connection with Marhowrah P.S. Case No. 482 of 2018.
