The petitioner seeks bail in connection with Bahadurganj P.S. Case No. 259 of 2018 registered under Sections 25(1-b/a)26/35 of the Arms Act.
Petitioner along with two persons were apprehended along with a motorcycle and from possession of the petitioner, two live cartridges were recovered, from possession of Sajid Ansari one country made sixer and one live cartridge and from possession of Sadrul, one knife was recovered. It is submitted by the learned counsel for the petitioner that petitioner is quite innocent and has been falsely implicated in this case. No incriminating article has been
Patna High Court Cr.Misc. No.78348 of 2018(2) dt.11-01-2019 2/2 recovered from his conscious physical possession. He has no concern with the aforesaid two accused persons. He was apprehended from his house and roped in this case showing aforesaid recovery from his possession at the instance of his enemy. He has no criminal antecedent. Petitioner has been languishing in custody since 23.08.2018.
On the other hand learned APP opposed the bail prayer of the petitioner.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Bahadurganj P.S. Case No. 259 of 2018.
