2. The petitioner apprehends his arrest in connection with Nabinagar P.S. Case No. 216 of 2021 registered under Sections 406 and 420 of the Indian Penal Code.
3. As per prosecution case, F.I.R. named accused persons took Rs. 3,80,000/- from the father of the informant for the purpose of selling of land but they did not execute the sale deed.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that the alleged incident took place in the year 2016-17 but F.I.R. has
Patna High Court CR. MISC. No.66546 of 2023(5) dt.10-05-2024 2/2 been lodged after delay of more than five years without any plausible explanation for the same. It is further submitted that there is no chit of paper on record to show the alleged transaction. Moreover, petitioner has not received any amount from the father of the informant. The dispute between the parties is purely civil in nature. Petitioner has got clean antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Aurangabad in connection with Nabinagar P.S. Case No. 216 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
