JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-11-2025 Heard learned senior counsel appearing on behalf of the petitioners, learned APP appearing on behalf of the State and learned counsel appearing on behalf of the informant.
2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 109, 303(2), 352, 351(2) and 351(3) of the B.N.S. and later on, Section 103(1) of the B.N.S. was added.
3. As per prosecution case, it is alleged that all the F.I.R. named accused persons, including these petitioners,
Patna High Court CR. MISC. No.62119 of 2025(3) dt.12-11-2025 2/3 assaulted informant and her husband as a result of which, husband of informant died during course of treatment.
4. It is submitted by learned senior counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. As per F.I.R., all seven F.I.R. named accused persons, including these three petitioners assaulted informant and her husband, however, as per post mortem report, only one injury was found on the body of the deceased which itself makes the entire prosecution case doubtful. Allegation of assault is general and omnibus and no specific accusation of overt act has been alleged against these petitioners. Petitioners are ladies and have falsely been implicated in this case merely because they happen to be family members of other co-accused persons. Husband of Petitioner Nos. 1 and 2 are already in custody. Petitioners claim clean antecedents.
5. On the other hand, learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
6. Considering the facts and circumstances of the case, general and omnibus nature of accusation and clean
Patna High Court CR. MISC. No.62119 of 2025(3) dt.12-11-2025 3/3 antecedents of the petitioners, who are ladies, the prayer for grant of anticipatory bail to the petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I Class, Udakishunganj, District- Madhepura in connection with Puraini P.S. Case No. 27 of 2025, subject to condition as laid down under Section 482(2) of the B.N.S.S..
