JUSTICE SANJAY PRIYA ORAL ORDER 07-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Muffasil P.S. Case No. 462 of 2016 instituted for the offence under sections 272 and 273 of the Indian Penal Code and 30(a) of the Bihar Excise Amendment Act, 2016.

It is alleged that police received information that illegal wine is being sold in general store and betel shop of this petitioner. It is further alleged that son of this petitioner was apprehended and two bottles of 180ml.each Royal Stag wine was recovered from the betel shop. It is alleged that son of the petitioner was apprehended who disclosed the name of this petitioner.

It is mentioned in para-3 that the petitioner has no criminal antecedent.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Muffasil P.S. Case No. 462/2016, corresponding to G.R. No. 6316 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, Champaran, subject to the conditions as laid down under Section 438(2) Cr.P.C (Sanjay Priya, J) Ravi/- U T
