The petitioners apprehend their arrest in Mohammadpur P.S. Case No. 57/2015, registered for the offences punishable under Sections 323, 379, 406, 420 of the Indian Penal Code and Section 3(I)(X) of S/ST Act.

The informant alleged that the petitioners came and persuaded her to provide passport for sending her son to Singapore for a monthly salary of Rs. 50,000/-. She arranged Rs. 1,75,000/-, but her son was sent to Malasia instead of Singapore and her son returned after three months.

It is submitted that the petitioners have falsely been

Patna High Court Cr.Misc. No.40826 of 2015 (2) dt.06-10-2015 2/2 implicated in the case. Her son went to Malasia for job, but he could not get any job on account of his incapability. The petitioners did not receive any money. The entire family members are made accused in the case.

Petitioner no. 4 is the wife of the petitioner no. 1 and there is no specific allegation against Upendra Mahto and Chinta Devi.

Considering the facts and nature of allegation, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Mohammadpur P.S. Case No. 57/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
