Petitioner seeks pre-arrest bail in Sachivalaya P.S.Case No.106 of 2017 /Spl.Case No.4126/17 registered under Sections 30(a), 38(1) of Bihar Prohibition and Excise Act. Allegation as per the F.I.R.is that in course of patrolling duty on seeing the police party two persons who were moving near I.P.S.More, started fleeing but they were apprehended and disclosed their names as Tiinku Kumar and Basant Kumar and both co-accused named this petitioner. Submission on behalf of the learned counsel for the petitioners is that nothing has been recovered and he is not accused in any similar type of the case and the police has lodged the present case falsely.
Heard the learned A.P.P. also.
Patna High Court Cr.Misc. No.78900 of 2018(2) dt.11-01-2019 2/2 Having heard both sides and in view of the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the learned court below within six weeks from today be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Patna, in Sachivalay P.S.Case No.106/17 /Spl.Case No.4126/17 subject to the conditions as laid down under Section 438(2) of Cr.P.C. and further condition that the bailors must be of local having sufficient movable and immovable properties within the jurisdiction of the court concerned.
