Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 413 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act. The petitioner was apprehended along with others on suspicion that they were preparing to commit dacoity. Submission is that no firearm or any incriminating article was recovered from the possession of the petitioner. After the present case, the petitioner has been remanded in two other cases, wherein petitioner is not named in the F.I.R. Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of

No.57185 of 2019(2) dt.13-09-2019 2/2 Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Salimpur Police Station Case No.90 of 2019, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
