JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-01-2019 Petitioner apprehends his arrest in connection with Valmik Nagar P.S. Case No. 42 of 2018 registered for the offences punishable under Sections 420, 467, 468, 470, 471 and 472 of the Indian Penal Code.

Allegation against the petitioner is of committing forgery in the document and causing loss to the Government exchequer.

Submission of learned counsel for the petitioner is that he was an Assistant Engineer, Chief Western Canal and he was transferred in the year 2012 and obtained No Dues Certificate and the present case has been lodged on the basis of measurement book which was found to be torn and petitioner has already superannuated from service and he is ready to co-

Having heard both sides and in the facts and circumstances, let petitioner, above named, surrender within a period of six weeks from the receipt of this order and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri A.F. Akarm, Judicial Magistrate, 1st Class, Bagaha, West Champaran, in connection with Valmik Nagar P.S. Case No. 42 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that petitioner has to cooperate in investigation, otherwise his bail bond shall be cancelled.
