The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 337.10 litres of IMFL was recovered from the house of the petitioner. It is submitted by learned counsel for the petitioner that the petitioner who is a lady has been falsely implicated in the case. The husband of the petitioner namely Vinay Kumar Singh has been enlarged on bail vide order dated 26.5.2022 passed in Cr. Misc. no. 1284 of 2022. The petitioner is in custody since 29.10.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the petitioner not having any criminal antecedent, having remained in custody for 7 months and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Town P.S. Case no. 840 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur.
