The petitioner apprehends his arrest in Jurawanpur P.S. Case No. 35 of 2015, registered for the offences punishable under Sections 364, 420, 406, 120B and 34 of the Indian Penal Code. The informant filed the complaint case on the basis of which the present FIR was registered. The informant named Sunita Devi, Tinku @ Tinku Kumar, the petitioner and Neha Kumari. The informant alleged that Sunita Devi came to her and disclosed that she is the officer of Versa Recovery Chit Fund. Sunita Devi persuaded the informant to deposit money in the chit fund. Altogether the informant deposited Rs. 12 lakhs but, the petitioner and others did not handover any passbook. It is further alleged that the petitioner and others took the informant to

Patna High Court Cr.Misc. No.15226 of 2017 (3) dt.15-05-2017 2/2 Malsalami office of the company and kidnapped her. Learned counsel for the petitioner submits that the entire allegation is false and concocted.

It appears from perusal of the case diary that the informant named the petitioner along with other accused persons and the victim was recovered in unconscious condition in Lucknow. The victim made specific allegation that the petitioner also took her on the point of revolver and thereafter she became unconscious.

Considering the nature of allegations made against the petitioner, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J.) KKSINHA/- U T
