The petitioner apprehends his arrest in connection with Ahiapur P. S. Case No. 589 of 2015 instituted under Sections 406, 467, 468 and 120B of the Indian Penal Code. The allegation, in brief, is that the petitioner was a Field Officer in one Tarsana Bank and collected Rs. 600/- each from 300 ladies including the informant in order to provide them loan for self employment, but the same was not provided and it is alleged that the petitioner along with other persons working in the bank misappropriated the collected money.
It is submitted that the petitioner joined the bank in the year 2014 and resigned in 2015 and the bank has given him No Dues Certificate for full and final settlement as such he has not
Patna High Court Cr.Misc. No.5678 of 2017 (3) dt.23-02-2017 2/2 collected or misappropriated any money and he has no criminal antecedent.
The police, during investigation, has collected sufficient materials against the petitioner and allegation is specific against him of collecting money in order to provide loan for self employment but he misappropriated the same. Hence, prayer for anticipatory bail is rejected.
The petitioner is directed to surrender before the court below and seek regular bail and if petitioner files application for regular bail, the same shall be considered on its own merits without being prejudiced by this order.
