JUSTICE BIRENDRA KUMAR ORAL ORDER 18-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code as well as Section 138 of N.I. Act. The parties were under an agreement to sell the land. The petitioner on failure to go with the agreement refunded the consideration amount through cheque which bounced. No offence under Section 420 of the Indian Penal Code is prima facie made out against the petitioner and offence under Section 138 of N.I. Act is bailable one.

Considering the aforesaid facts, let the petitioner,

Patna High Court Cr.Misc. No.11083 of 2017 (2) dt.18-03-2017 above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarpur/Successor Court in connection with Complaint Case No.C519 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
