The petitioners apprehend their arrest in Muffasil P.S. Case No. 34 of 2016 registered for the offences punishable under Sections 307, 498A and other Sections of the Indian Penal Code and under Sections 3/4 of the Dowry Prohibition Act. The informant alleged that Priti Kumari was married with Bharat Singh, son of the petitioners, in the year 2013 but her husband and other in-laws subjected her to physical and mental torture due to additional demand of dowry. The informant got information that on 04.03.2016, the accused persons burnt his niece after sprinkling kerosene oil.
Learned counsel for the petitioners submits that the petitioners are father-in-law and mother-in-law of the deceased.
Patna High Court Cr.Misc. No.9037 of 2017 (4) dt.11-05-2017 2/2 The deceased died during course of treatment. Her husband also got injuries when he tried to save his wife. During course of treatment, the victim made her statement in hospital situated in Kankarbagh, Patna that she accidentally got fire but, on perusal of the case diary it appears that the informant and other witnesses have stated that the victim was subjected to torture due to nonfulfillment of demand of additional dowry and she died of burn injuries. The victim was also treated in Sadar Hospital but her statement was not recorded. The victim got 75 percent burn injuries.
Considering the nature of allegations, I am not inclined to enlarge the petitioners above named on anticipatory bail. Accordingly, the same is rejected.
