JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-01-2019 This application, for grant of anticipatory bail, arises out of Mahila P.S. Case No. 13/17, disclosing offences under Sections 498A/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

Allegation against the petitioner that he married with the informant and, thereafter, he remarried with second lady and ousted the informant from his house and also demanded dowry of Rs. 2,50,000/- Submission of learned counsel for the petitioner is that he is still ready to keep the informant with himself with full honour and dignity as a wife and allegation of second marriage is false and concocted.

Having heard both sides, from perusal of the impugned

Patna High Court Cr.Misc. No.78340 of 2018(2) dt.08-01-2019 2/2 order it appears that the informant had appeared before the court below and the petitioner flatly denied to keep her with himself, as such, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner should surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order. This application is, accordingly, dismissed.
